Brookville Man Accused of Hitting, Kicking Dog

BROOKVILLE, Pa. (EYT) – A Brookville man is facing charges after allegedly hitting and kicking his dog near a business in Brookville.

Court documents indicate the Brookville Borough Police Department filed the following charges in Magisterial District Judge Gregory M. Bazylak’s office on Thursday, July 12, against 41-year-old Brian Keith Adkins, of Brookville:

– Cruelty to Animals, Misdemeanor 2
– Public Drunkenness And Similar Misconduct, Summary

According to a criminal complaint, around 1:37 a.m. on Saturday, July 7, Officers Gray and Gallagher were dispatched to the area of a bar on Pickering Street for a report of a bald male wearing shorts and a shirt with the sleeves cut off who was allegedly hitting, kicking, and throwing a dog against the wall outside the business.

While en route, the officers observed a person who matched the description of the man in the area of another business on Pickering Street and stopped to speak with him. Officer Gallagher noted he recognized the man from previous encounters as Brian Adkins, the complaint states.

According to the complaint, Officer Gallagher asked Adkins what had happened, and Adkins responded “nothing” and said he was walking home from a local bar. Officer Gallagher explained that police had received a report that he was kicking and hitting his dog, and Adkins stated that he did not hit the dog and “was not sure what I was talking about.”

The complaint states that Adkins stated the dog was walking without a leash and walked away from him, so he had to go up by the bar and pick him up and put him on the leash.

Officer Gallagher then spoke with the witness of the incident, who was standing on the edge of the bridge.

According to the complaint, the witness stated that Adkins was outside the bar, and the dog got away from him and ran up the ramp outside the front door. The witness said she heard the dog yelping and whining, and Adkins was punching and kicking the dog.

The witness stated she heard a loud thump on the door and was not sure if it was Adkins falling into the door or him throwing the dog against the wall.

Officer Gallagher asked the witness if she was willing to testify to what she saw, and she said that she was.

Officer Gallagher then returned to Adkins and asked him again what happened with the dog. Adkins again stated that he never hit the dog and said it did not yelp at all.

Officer Gallagher informed Adkins that the dog was going to be taken to the police kennel because the officers did not feel that Adkins was able to care for the dog due to his level of impairment. He also advised Adkins that he was going to be charged with public drunkenness and cruelty to animals and advised him to contact someone that he could be released to.

Officer Gray transported the dog to the kennel, and Officer Gallagher transported Adkins to be released to a friend’s custody at a residence on Richards Street.

The dog was transported to the kennel and given food and water, Officer Gray photographed its injuries, which included open wounds that were still bleeding on the backs of its legs, a wound on the top of his head, and bruising on the inside of its left ear, according to the complaint.

A preliminary hearing is scheduled for 11:15 a.m. on Tuesday, August 14, with Judge Bazylak presiding.
