Charges Move Forward Against Jefferson County Man Accused of Grabbing Victim’s Hair, Banging Her Head Off Kitchen Floor

BROCKWAY, Pa. (EYT) – Charges against a Jefferson County man who allegedly grabbed a victim by the hair and banged her head off the kitchen floor during a domestic dispute were waived for court.

According to court documents, the following charges against 39-year-old Nathan P. Gunning, of Brockway, were waived for court:

  • Simple Assault, Misdemeanor (two counts)
  • Harassment – Subject Other to Physical Contact, Summary (two counts)

The charges have been transferred to the Jefferson County Court of Common Pleas.

Gunning is currently free on $20,000.00 unsecured bail.

Jury Selection is scheduled for 9:00 a.m. on June 6, 2019, in front of President Judge John H. Foradora.

Details of the case:

According to a criminal complaint filed by Chief Young, of the Brockway Borough Police Department, he was dispatched around 12:35 a.m. on January 13, 2019, to 932 9th Avenue for a domestic dispute with injuries.

When he arrived at the scene, he saw a red car pulling away from the residence. He flashed his flashlight to get the driver’s attention, and the car stopped. A known woman (the victim) was crying in the passenger’s seat.

The victim stated that Nathan Gunning (aka Nate) was inside the residence.

The victim reported that Nate grabbed her head and banged it off the floor several times. At this time, she turned her head and pointed out the blood on the back of her head, and she said that her head hurts. When she lifted her left hand, Chief Young noticed there were cuts just above her thumb. The victim repeated that Nate grabbed her hair and banged her head on the floor several times.

When Chief Young asked if Nate was intoxicated, everyone in the car stated: “Yes, he is very intoxicated,” according to the complaint.

At this time, Chief Young advised the victim’s son to drive her across the street where the ambulance was staging.

Nathan (Nate) Gunning Taken into Custody

With assistance, Chief Young approached the front door of the residence at 932 9th Avenue.

Before entering the residence, Chief Young could see Nate leaving the living room and heading towards the kitchen. Chief Young opened the front door and yelled at Nate to get on the floor. Nate took several steps toward Chief Young then knelt on the floor. He was taken into custody.

According to the complaint, Nate stated, “Here we go again.”

Nate was secured in the patrol car by a deputy sheriff and a PA constable.

Victim Interviewed

Chief Young went to the ambulance to talk to the victim again.

The victim said that Nate accused her of calling a known boy retarded, but she stated that she never did. When they were leaving a local bar, Nate punched her in the head, and they continued arguing the whole way home.

When they got home, the situation got worse. In the kitchen, Nate grabbed her hair and then started banging it off the kitchen floor. The victim stated he did it about four, five, or six times, and that’s when her son came inside the house.

The victim had cuts on her forehead, and she told Chief Young that it was from Nate, but she was not sure exactly how that happened.

Nathan (Nate) Gunning Inteviewed

At the station, Officer Stutsman Mirandized Nate, and he agreed to talk.

Nate stated that when they were leaving a local bar, his girlfriend (the victim) called his son a retard. Nate stated that this made him mad, and he reached over and smacked her across the head. He stated that when they got home, the victim kept at him and kept calling his son a retard. At that time, Nate said that “he did grab her hair to get her away from himself.”

When Nate was asked why the victim had blood on the back of her head, at first he did not know, then he replied that “he must have pulled her hair too hard,” according to the complaint.
