Two Waive Hearing on Charges in Connection with Violent Robbery in Pine Creek Township

PINE CREEK TWP., Pa. (EYT) – Two men facing felony charges for their alleged involvement in a violent robbery in Pine Creek Township waived their preliminary hearings on Wednesday.

According to court documents, 28-year-old Eithen Lee Miller, of Clarington, and 25-year-old Nicholas Scott Ross, of Brookville, both waived their preliminary hearings on Wednesday, October 7.

The following charges against Miller were waived for court:

  • Conspiracy – Robbery-Take Property From Other by Force, Felony 1
  • Robbery-Inflict Threaten Immediate Bodily Injury, Felony 2
  • Robbery-Take Property From Other by Force, Felony 3
  • Theft By Unlawful Taking-Movable Property, Misdemeanor 1
  • Strangulation – Applying Pressure to Throat or Neck, Misdemeanor 2
  • Simple Assault, Misdemeanor 2

The following charges against Ross were waived for court:

  • Robbery-Inflict Threat Immediate Serious Injury, Felony 2
  • Conspiracy – Robbery-Inflict Threat Immediate Serious Injury, Felony 2
  • Robbery-Take Property From Other by Force, Felony 3
  • Theft By Unlawful Taking-Movable Property, Misdemeanor 1

The charges have been transferred to the Jefferson County Court of Common Pleas.

Miller remains lodged in the Jefferson County Jail pending $100,000.00 monetary bail and Ross remains lodged in the Jefferson County Jail pending $80,000.00 monetary bail.

Details of the case:

According to a criminal complaint, around 7:40 p.m. on Sunday, September 16, Trooper Suprano, of the Punxsutawney-based State Police, was assigned to investigate a reported robbery that occurred along U.S. 322 in Pine Creek Township, Jefferson County.

The known victim stated that he inquired through Facebook for a ride from Giant Eagle in DuBois to Brookville Borough and Nicholas Scott Ross and Eithen Lee Miller gave him a ride.

The victim reported that Ross was driving his Chevrolet Silverado 2500 pickup truck, and during the drive, Eithen Miller reached over the seat, strangled, and punched him in the face. Miller and Ross then allegedly stole money, a cell phone, and a laptop computer from the victim with a total value of $700.00.

According to the complaint, Ross admitted to the crime and implicated Miller as being involved. Ross stated that Miller instructed him to “run his pockets” and steal money from the victim’s wallet.

The complaint notes the victim displayed bruising along his neck, a bloody nose, and bruising along his waistline.

According to the complaint, during the robbery, the victim was told, “Don’t struggle, or we’re going to kill you. I’ve put people in body bags before.”

Miller was arraigned at 4:36 p.m. on Saturday, October 13, in front of Magisterial District Judge Bazylak.
