Hearing Scheduled for Man Accused of Attempting to Pick Up Children from School While Nearly Three Times Over Legal Limit

BROOKVILLE, Pa. (EYT) – A hearing has been scheduled for a Brookville man who allegedly arrived at a Brookville elementary school while intoxicated to pick up children.

According to court documents, 45-year-old Richard W. Murray, of Brookville, is scheduled to stand for a preliminary hearing in front of Magisterial District Judge Gregory M Bazylak at 2:30 p.m. on Thursday, January 10, on the following charges:

– DUI: General Impairment/Incompetent of Driving Safely – 1st Offense, Misdemeanor
– DUI: Highest Rate of Alcohol (BAC .16+) 1st Offense, Misdemeanor
– Endangering Welfare of Children – Parent/Guardian/Other Commits Offense, Misdemeanor 1 (two counts)
– Careless Driving, Summary

Case details:

According to a criminal complaint, around 3:53 p.m. on November 1, 2018, Officer Stormer was dispatched to a Brookville elementary school for a suspected driving under the influence violation.

The complaint states that school Police Officer Melinda Warnsing believed that Murray had consumed alcoholic beverages and arrived at the school to pick up two elementary-aged children.

Based on the observations of both Warnsing and Officer Stormer, it was believed that Murray was under the influence of alcohol and he was placed under arrest. He was transported to Penn Highland Brookville Hospital where he consented to a blood draw.

According to the complaint, “had Warning not held Murray for investigation, he would have likely placed those two children in his vehicle and transported them while under the influence of alcohol.”

The lab report received on December 3 from the PA State Police Bureau of Forensic Services of Erie indicated that Murray’s blood contained 0.23% Ethyl Alcohol.

Based on the lab results, charges were filed against Murray in Magisterial District Judge Gregory M. Bazylak’s office on Tuesday, December 4.

New Charges Filed Against Murray

Murray was arraigned at 6:17 p.m. on December 21 in Gregory M. Bazylak office stemming from an incident in Brookville Borough:

– DUI: General Impairment/Incompetent of Driving Safely – 2nd Offense, Misdemeanor
– Fleeing or Attempting to Elude Officer, Felony 3
– Failure To Keep Right, Summary

He was lodged in the Jefferson County Jail on $40,000.00 monetary bail.

He was released on December 27 after he posted 10% bail ($4,000.00).

A preliminary hearing on this case is also scheduled for 2:30 p.m. on January 10 in front of Judge Bazylak.
