BROOKVILLE, Pa. (EYT) – Brookville Borough Police say a 20-year-old Brookville man has been arrested on 35 counts of sexual related crimes against a 14-year-old girl.
According to a Criminal Complaint, on August 7, 2014, at approximately 2:30 p.m., Investigating Officer Mick Stormer received a request from the Brookville Police Department to call a woman who claimed that her 14-year-old daughter had been having sexual intercourse with a known 20-year-old male.
According to the Affidavit, the mother was informed by a family member that her daughter allegedly had sex with 20-year-old Devon Stuart, of Brookville.
August 8, 2014, Interview at Brookville Police Station
On August 8, at approximately 11:14 a.m., Officer Stormer interviewed the 14-year-old victim. He asked her how she knew Devon Stuart, and she said she met him a long time ago while at the Scarlet Cord. When asked if she had any sexual relationship with Stuart, she stated “yes.” She stated that she first had sexual intercourse with him on July 26, 2014, around 12:00 p.m. She stated Stuart wore a condom during the encounter and that it took place at a residence in Rose Township, Jefferson County. She said they communicated via text messages.
It is believed that Stuart was in the borough of Brookville at his residence on Church Street, and he allegedly walked from his residence and met the victim outside another residence, and they walked into a nearby wooded area and allegedly had sexual intercourse. The victim allegedly stated she and Stuart received a condom from an unnamed person so they could have sexual intercourse.
The victim stated that she and Stuart met at the Walter Dick Park on July 31, 2014, after establishing a meeting through the use of text messages. The victim used her friend’s cell phone to contact Stuart on his cell phone.
After agreeing to meet at the park, Stuart and the victim walked along an established trail and allegedly had sexual intercourse twice in the woods near the trail. She stated that she and Stuart each had a condom and that Stuart used a condom both times. The victim stated that Stuart placed the condoms in his pants pocket and did not leave them in the woods.
On August 3, 2014, the victim and Stuart established a meeting using an unnamed person’s cell phone to send text messages to Stuart’s cell phone. She stated that she and Stuart met at the Walter Dick Park and again they had sexual intercourse in the woods near the trail. She stated Stuart used a condom.
August 8, 2014, Interview at Brookville Police Station
On August 8, around 5:00 p.m. Officer Stormer interviewed family members. He asked a family member if she knew of any type of relationship between the victim and Devon Stuart. She stated she knew the two had dated on and off for approximately two weeks and that the victim told her she had sex with Stuart. The family member was asked if she knew about Stuart and the victim having sexual intercourse at her house, and she stated they did not ever have sex at her house. Officer Stormer asked is she provided condoms to the victim or Stuart. She stated she had condoms in her dresser drawer and that the victim told her she was taking some of them.
Officer Stormer asked the family member if she knew where and when the victim and Stuart had sex, and she stated it happened sometime at the end of July, 2014, and that the victim told her they had had sex in the woods near the old railroad tracks tunnel. Officer Stormer stated he knew of such a tunnel near their residence and that tunnel is in the borough of Brookville.
August 9, 2014, Interview at Residence
On August 9, 2014, at 12:00 p.m., Officer Stormer met with the victim and her mother at their residence.
He asked the victim if she had sexual intercourse with Stuart at their residence, and she stated “no,” and that it happened in the woods and not in the house.
Officer Stormer asked the victim how she came in contact with Stuart that day, and she stated she used an unnamed person’s iPod to send and receive text messages from Stuart. Officer Stormer asked if the victim could show the exact location where she and Stuart had sex, and the victim took him to the location.
Officer Stormer and the victim walked through the back yard at her residence and into the wooded area. The victim showed him the area in which she had sex with Stuart. In the immediate area, he noticed a blue Trojan brand condom wrapper laying on the ground. The victim stated she believed that was the condom wrapper that contained the condom Stuart wore during their sexual encounter. Officer Stormer used a rubber glove and seized the wrapper. No condom was found in that area.
Investigators Obtain Victim’s Diary
On August 9, 2014, at approximately 12:00 p.m., Officer Stormer was provided a diary book belonging to the victim.
Listed are the diary entries made by the victim that Officer Stormer believes are regarding her alleged relationship with Stuart:
– On July 11, 2014, the victim wrote that she saw “Devon” on this date and talked about how much she likes him and how the two might be able to get together when she is older.
– On July 15, 2014, the victim stated she went to her friend’s house on Saturday, July 12, and had stayed with her ever since. She stated she went to the fair on this date and saw Devon. She then wrote that the two kissed just prior to riding a fair ride name “the ring of fire,” then wrote that she believes she and Stuart are dating.
– On July 30, 2014, the victim wrote about being at her cousin’s house for a week and returned home on July 29, 2014. While there, Stuart went to the residence to see her. She wrote in her diary, “we *****ed…it was okay I guess.” The entry then talks about her and Stuart breaking up on July 27, 2014, because Stuart cheated on her. At the bottom of the entry, she wrote, “Devon + Me + 7-26-2014.”
– On August 4, 2014, the victim wrote about being at an unnamed person’s house and that she and her “snuck out” to see their boyfriends. She also talks about she and Devon not actually being together due to a fight they had, but the two had got back together during this meeting. She wrote, “Oh I ****ed Devon. Best time of my life:)” Later in the entry, the victim wrote, “I’ve done it with Devon 4 times. Oh yes he’s giving me one of his hoodies. Everytime we did it I scratched the **** outa him :)” The victim adds at the bottom of the entry, “Mine first time: 7-26-2014: I’m 14.”
– On August 6, 2014, the victim stated that Devon had come to see her at 2:36 a.m. while at her residence. She also wrote, “we did it again. 5th time. We’ve done it…7-26-14, 7-31-14 twice, 8-3-14 and 8-6-14. I remember everytime cuz I feel those times were special to me. Guess what…he gave me a teddy bear. It smells just like him. Oh and the night (friend’s name) and I snuck out he said that nights sex was amazing. I agreed cuz it was. He walked to my house.”

Officer Stormer requested to speak to the victim after reading her diary entry made on August 6, 2014.
On August 9, 2014, at 3:00 p.m. he met with the victim and her mother at the Brookville Police Department.
When the victim arrived at the station for the interview, she brought with her the teddy bear that Stuart had given her, and the officer seized it.
During that interview, the victim stated she contacted Stuart from her residence located within the Brookville Borough, Jefferson County. She said she used an unnamed person’s cell phone to send and receive text messages with Devon Stuart.
The conversation between the victim and Stuart resulted in Stuart arriving at the victim’s residence and the two met outside around 2:30 a.m. on August 6. The victim and Stuart then had sexual intercourse in the back yard at the residence. The victim stated that Stuart did not use a condom. Afterward, the two talked for approximately five minutes before Stuart left, and the victim returned inside the residence.
August 28, 2014
On August 28, 2014, Officer Stormer received text message data that showed Stuart’s phone had sent or received 25 text messages from a known phone number on August 2, 2014, between the hours of 11:28 p.m. and 11:59 p.m. On August 3, 2014, from the hours of 12:01 a.m. and 2:37 a.m., the same number then sent and/or received approximately 123 text messages to/from Stuart’s phone number. During that time frame, it was also established that Stuart sent an email to the known phone number.
Also established from the same records was communication between Stuart’s phone number and a known phone number between the times and dates of 11:01 a.m. on August 5, 2014, and 2:20 a.m. on August 6. Approximately 192 text messages were sent and received between the two phone numbers.
Based on the interviews, cell phone records, and physical evidence, police filed the following charges against Devon Stuart:
– 5 counts of Involuntary Deviate Sexual Intercourse, Victim Less Than 16 Years Old and More Than 6 Years Younger, Felony 1
– 5 counts of Statutory Sexual Assault, Felony 2
– 5 counts of Aggravated Indecent Assault, Less Than 16 Years Old, Felony 2
– 5 counts of Indecent Assault, Complainant Less Than 16, Actor More Than 4 Years Older, Misdemeanor 2
– 5 counts of Unlawful Contact with Minor, Chapter 31/Sex Offenses, Felony 1
– 5 counts of Criminal Use of Communication Facility, Commission of Felony, Felony 3
– 5 counts of Corruption of Minors, Felony 3
Stuart was arraigned on September 2. Unable to post $60,000.00 bail, he is lodged in the Jefferson County Jail.
A preliminary hearing is scheduled for 9:00 a.m. on September 12 in front of District Judge Gregory M. Bazylak.
In another felony criminal case against Stuart from an offense on March 18, 2014, jury selection is scheduled for 9:00 a.m. on September 8, 2014, in front of President Judge John H. Foradora.
In this case, Stuart is facing the following offenses:
– 3 counts of Corruption Of Minors – Defendant Age 18 or Above, Felony 3
– 2 counts of Child Pornography, Felony 3
– 3 counts of Diss Explicit Sex Material Minor, Felony 3
– 3 counts of Harassment – Comm. Repeatedly in Anonymous Manner, Misdemeanor 3
According to court documents, Stuart’s bail was set at $25,000.00 Unsecured.
