AG Kane Joins 16 Other States Requesting Lower Alcohol Content in ‘Four Loko’ Malt Beverages

HARRISBURG, Pa. – Attorney General Kathleen G. Kane and attorneys general from 16 other states this week expressed serious concerns about the alcohol content in Four Loko in a letter sent to Phusion Projects, LLC, the company that sells the flavored malt beverage.

With a 12 percent alcohol concentration in a 23.5-ounce container, one can of Four Loko contains 4.7 servings of alcohol. Based on Centers for Disease Control standards, drinking just one can of Four Loko may constitute a binge drinking episode.

“Alcohol use and binge drinking among teens and young adults is a serious problem in Pennsylvania,” Kane said. “We are calling on Phusion to lower the alcohol content in Four Loko to the industry standard.”

In March of 2014, a settlement joined by 20 attorneys general resolved allegations that Phusion Projects, LLC marketed and sold Four Loko in violation of consumer protection and trade practice statutes by promoting the alcohol beverage to minors.

The letter sent this week mainly focused on remaining concerns regarding Four Loko’s alcohol content. The letter asks Phusion Projects, LLC to “take immediate steps to significantly reduce the alcohol content in Four Loko to the industry standard of 8 percent alcohol by volume on [a] 24 oz package.” Making these changes will reduce the serious public safety risks posed by Four Loko, the attorneys general argued in the letter.

Also signing the letter were attorneys general from Hawaii, Idaho, Illinois, Indiana, Iowa, Kansas, Kentucky, Michigan, Mississippi, New Mexico, North Carolina, Ohio, Rhode Island, South Carolina, Vermont and the District of Columbia.
