Attorneys Continue Plea Negotiations in Curry Child Sex Case

thomas-curry-mugshotCLARION, Pa. (EYT) — Plea negotiations in the child sex case against Thomas Eugene Curry, 65, of Rimersburg continue in Clarion County.

UPDATE: Curry Found Not Guilty on all charges

Curry faces nearly 2,000 charges for allegedly sexually assaulting a girl from the time she was 10 until she was 13.

Curry and his attorney, Gary Gerson of Pittsburgh, have had four Criminal Conferences with the Clarion County District Attorney’s office since early April.

Assistant District Attorney Drew Welsh confirmed plea negotiations are ongoing.

“There have been multiple conversations,” Welsh said. “We have met with Mr. Gerson a number of times and spoken with him on the phone as well.”

“I don’t want to comment on the nature of the conversations and at this point, I can’t say whether there will be a trial. We haven’t reached an agreement and until then, I always feel we will be headed to trial.”

Gerson had no comment in relation to the plea negotiations. He did file a Motion to Compel June 24 and Welsh confirmed that the defense was seeking evidence related to the case.

Curry has a plea court date Wednesday, July 6 at 2 p.m., but that does not necessarily mean Curry will accept a plea that day. The court sets the schedule for Criminal Conferences and Plea Court, among other things. Curry can still choose to go to trial or the date can be pushed back to a later time.

The following charges were filed against Curry on January 22, 2016:

• Rape of Child, Felony 1 (312 counts)
• Involuntary Deviate Sexual Intercourse W/Child, Felony 1 (208 counts)
• Incest, Felony 2 (312 counts)
• Sexual Assault, Felony 2 (312 counts)
• Indecent Assault – Person Less Than 13 Years of Age, Felony 3 (312 counts)
• Corruption of Minors – Defendant Age 18 or Above, Felony 3 (1 count)
• Corruption of Minors, Misdemeanor 1 (312 counts)
• Statutory Sexual Assault, Felony 2 (208 counts)
• Intimidation of Witness/Victim – Refrain from Report, Felony 1 (2 counts)
• Terroristic Threats with Intention to Terrorize Another, Misdemeanor 1 (2 counts)

According to a criminal complaint, on Jan. 22, 2016, the New Bethlehem Police Department issued an arrest warrant for Curry for alleged sexual offenses against a female minor.

The alleged crimes occurred on or about June 24, 2011, and continued for approximately a three-year period.

Prosecutors say the victim was 10 years old when the alleged crime began and continued until she was 13 years old.

Curry was jailed on Jan. 22 and released after posting $25,000 cash bail.

Following a preliminary hearing in front of Magisterial District Judge Timothy Schill on Feb. 2, the case against Curry was transferred to Clarion County Court of Common Pleas.
