JEFFERSON CO., Pa. (EYT) – A Brookville man who reportedly attempted to resist arrest on a warrant waived his hearing in court on Tuesday.

Court documents indicate the following charges against 33-year-old Benjamin David Snair were waived for court on June 8:

– Resist Arrest/Other Law Enforcement, Misdemeanor 2
– Disorderly Conduct Hazardous/Physical Offense, Misdemeanor 3
– Possession of Controlled Substance, Misdemeanor
– Use/Possession of Drug Paraphernalia, Misdemeanor

The charges have been transferred to the Jefferson County Court of Common Pleas.

Snair remains lodged in the Jefferson County Jail on $5,000.00 monetary bail.

The charges stem from an incident in Punxsutawney in late April.

According to a criminal complaint, on April 22, Punxsutawney Borough Police were requested to assist Jefferson County Probation Officers with serving a warrant on Benjamin Snair in Punxsutawney Borough.

The complaint notes the officers were warned that Snair has attempted to flee from police in the past.

According to the complaint, a known female was supposed to pick Snair up and stop for cigarettes before leaving town, and police planned to wait until the woman entered the store, then surround the vehicle on foot and take Snair into custody. However, police then discovered that Snair went into the business with the woman.

The complaint states when Snair saw an officer in uniform, he started to walk quickly to the door and police followed. Snair then reportedly ran for the door and nearly ran over a customer attempting to enter.

Officers followed Snair into the parking lot and told him to stop. He allegedly continued to run through the parking lot and after being told to stop a second time and ignoring the order was tased by one of the probation officers.

Snair was then taken into custody.

The complaint notes that at the time of the arrest, Snair was found to be in possession of two glass smoking pipes with methamphetamine residence and three small baggies of methamphetamine, weighing a total of approximately three grams.

The charges were filed against Snair through Magisterial District Judge Jacqueline J. Mizerock’s office on April 29.

Court documents indicate Snair has a criminal history in the area dating back to 2007 with charges ranging from DUI and theft to drug possession.
