Charges Filed Against Area Man Accused of Assaulting Woman During Domestic Dispute

YOUNG TWP., Pa. (EYT) – Charges have been filed against an area man accused of grabbing, pushing, and throwing a woman during two domestic incidents that occurred last year.

Court documents indicate the Punxsutawney-based State Police filed criminal charges against 43-year-old Damian Edward Foster, of Walston.

According to a criminal complaint, on December 18, Punxsutawney-based State Police interviewed a known victim regarding an alleged theft, and during the interview, the victim reported physical domestic abuse where she allegedly received visible injuries from Damian Foster.

According to the complaint, the alleged abuse began in the middle of June 2020 and had continued through December 9, 2020.

The victim told police that Foster had been accusing her of stealing from him since June and became physically abusive about it. She reported that in June, she drove him to his residence, and Foster told her someone had broken into his basement and was upset about it. The victim said she and Foster were in the basement, and she went upstairs to get a drink. Then when she returned to the basement, Foster allegedly began yelling at her about stealing from him. She told him she’d never stolen anything, but Foster said “if she did not steal from him, then he was going to take it out on her anyway,” the complaint states.

According to the complaint, the victim told police that Foster then grabbed her and threw her onto a pile of metal and pipes, causing a severe bruise on her right lower back. She also allegedly ended up with a bruise on her right shoulder during the same incident but wasn’t sure exactly when it occurred.

The victim reported a second incident on December 9. She told police she had driven Foster to his house, and they got into a verbal altercation in the driveway. She reported that Foster yanked her car keys out of her hands, then went into his residence.

The complaint states the victim went on to report that she honked her horn until Foster threw her keys in the alley just off the road. Foster then allegedly picked up the keys and put them on the victim’s car, at which point the victim noticed her house key was missing and began honking again.

The victim told police Foster then came into the front passenger seat of her vehicle, grabbed her head, and was pushing and pulling against her before getting out of the car. Although the victim left, she returned later to try to get her house key.

According to the complaint, the victim reported she went into Foster’s residence and they then got into a physical altercation in his living room during which Foster grabbed her and threw her on the couch, causing bruises to her chest.

She provided police with photographs of her injuries from both incidents, the complaint notes.

Foster was also interviewed about the incidents and reportedly denied all of the allegations. He also told police that on December 9, when the victim came to his residence, she pushed him and he “put his arms out to keep her from hitting him,” the complaint indicates.

The following charges were filed against Foster on December 31, 2020:

– Simple Assault, Misdemeanor 2
– Harassment – Subject Other to Physical Contact, Summary

A preliminary hearing is scheduled for 1:00 p.m. on February 1, with Judge Mizerock presiding.
