PUNXSUTAWNEY, Pa. (EYT) – A Brookville man is facing felony charges in connection with two controlled buys conducted by the Jefferson County Drug Task Force.
Court documents indicate the Jefferson County Drug Task Force filed the following criminal charges against 30-year-old Dustin Alan Davis, of Brookville:
– Dealing In Products Unlawful Act/Intent To Promote, Felony 1
– Criminal Use Of Communication Facility, Felony 3 (two counts)
– Sell Noncontrolled Substance Represented as Substance Controlled, Felony (two counts)
Davis is currently lodged in the Jefferson County Jail.
Details of the case:
According to a criminal complaint, around 11:48 a.m. on January 26, 2018, an agent of the Jefferson County Drug Task Force made contact with Dustin Alan Davis via Facebook to set up a controlled purchase of a controlled substance. Davis wanted money in advance, but the agent told him he was not comfortable since he “had been burnt (too) many times by other people.”
Davis stated he would be making a trip to “reup” soon, a reference to stocking up on drugs and asked how much the agent could “throw,” in reference to how much he was willing to spend. The agent requested a gram and requested half of the money in advance. The agent said he would prefer “cash for crystal.” They discussed prices and quantities and settled on $200.00 for 1.25 grams. The agent told Davis he would be “coming to town,” referring to Punxsutawney, and Davis said he would have someone meet him.
An exchange was made, and officers returned to the Punxsutawney Borough Police Station and tested the crystal substance. The test came back negative for methamphetamines and was concluded to be rock salt. The baggie of salt and the test kit were placed into evidence.
Around 12:07 p.m. on February 7, 2018, an agent of the Jefferson County Drug Task Force made contact with Davis again, via Facebook, and asked him if he was going to be around that night. The agent arranged the purchase of a controlled substance for $300.00. They agreed to meet around 5:30 p.m.
After the exchange was made, a marked PSP patrol cruiser and a Punxsutawney Borough Police cruiser conducted a traffic stop on the vehicle involved in the exchange. The male passenger in the back seat attempted to flee but was apprehended a short distance away. All of the other passengers, along with the driver, were taken out of the vehicle, handcuffed, and searched.
The driver was identified as Lucianne Marsh, and the passengers were identified as Raymond Marsh, Michael White, and Heather Kellar.
In questioning, Lucianne Marsh allegedly admitted she also drove the vehicle at the time of the first controlled buy, when Davis rode in the back seat. She also allegedly admitted the substance they sold the agent as crystal meth was actually Epsom salts. Marsh gave consent to search the vehicle more thoroughly, and officers found hypodermic needles and $300.00 cash with serial numbers that matched the recorded serial numbers of the money used for the controlled buy.
All of the evidence collected, and the suspects were transported to the Jefferson County Jail.
Charges against Davis were filed on Tuesday, March 20, in Magisterial District Judge Jacqueline J. Mizerock’s office.
A preliminary hearing is scheduled for 2:30 p.m. on Tuesday, March 27, with Judge Mizerock presiding.
