Curry Not Guilty on All Charges

curry-mug-not-guiltyCLARION, Pa. (EYT) – Thomas Curry was found not guilty on all charges Thursday evening at the Clarion County Courthouse.

Curry faced nearly 2,000 charges alleging that he sexually assaulted, raped, and threatened the victim while she was living at his residence in Rimersburg.

A jury of seven women and five men began deliberations around 1:30 p.m. and returned with a not guilty verdict just before 7:00 p.m.

After the verdict was announced, the jury dismissed. There were hugs among the Curry family and friends that stayed to hear his fate.

Curry said he felt “complete relief” after the trial.

His attorney, Gary Gerson felt the verdict hinged on the credibility of the victim.

“There are no winners here, and as a father, I hate to see a child go through this, but I believe the issue in this case was the credibility of the purported victim,” Gerson said.

“I give the jury credit for getting past the fact of a child victim, but you still have a family torn apart over this. It’s just very unfortunate.”

Thursday began with one last witness for the defense and closing arguments by Gerson and County Assistant District Attorney Drew Welsh.

Wednesday’s testimony came from the defendant, the victim, the victim’s father, and the forensic nurse that interviewed the victim.

Nurse Kimberly Fugate described her interview with the victim and detailed the injury she had suffered.

The victim testified to her assault, her living circumstances, her life with her mother and the defendant.

She gave conflicting testimony at times, but her story was disturbing and heart-rendering considering she was raised by two parents who were reportedly addicted to Heroin.

Tuesday’s testimony centered on the victim’s living situation and how she told her mother about the abuse in November 2014.

Her mother called Butler County Children and Youth Services the following day, and they informed Clarion County CYS, which informed law enforcement. The New Bethlehem Police Department initiated the investigation.

Curry wasn’t arrested until January 22, 2016. He posted bail four days later.
