Hearing for Brockway Man Facing Statutory Sexual Assault Charges for Having Sex With 15-Year-Old Girl Set for Next Week

JEFFERSON CO., Pa. (EYT) – A hearing is scheduled for next week for a Brockway man who allegedly engaged in sexual intercourse with a 15-year-old girl.

Court documents indicate 21-year-old Damian Scott Nichols is scheduled to stand for a preliminary hearing in front of Magisterial District Judge David B. Inzana at 3:30 p.m. on January 26, on the following charges:

– Statutory Sexual Assault: 4-8 Years Older, Felony 2 (two counts)
– Corruption of Minors – Defendant Age 18 or Above, Felony 3

He is currently free on $40,000.00 unsecured bail.

The charges stem from an investigation into a report of a sexual assault in the summer of 2020.

Details of the case:

According to a criminal complaint, around 9:00 a.m. on June 20, 2020, a known 15-year-old juvenile victim arrived at the DuBois-based State Police barracks to report a sexual assault.

According to the complaint, the victim stated that Damian Scott Nichols, who was 20 years old at the time of the report, “took advantage” of her against her will on the night of June 9, 2020, at a mutual friend’s house. The victim reported that Nichols had intercourse with her in an upstairs bedroom. The victim also told police they were both under the influence when the incident occurred.

Police then interviewed Nichols on October 24, 2020.

Nichols denied taking advantage of the victim and told police that the intercourse was consensual, the complaint states.

The victim was then interviewed again on November 8, 2020, at which time she reportedly stated that the intercourse was consensual and Nichols “never took advantage of her,” according to the complaint.

Nichols was arraigned in front of Magisterial District Judge David B. Inzana at 10:15 a.m. on December 16, 2020, on the following charges:

– Statutory Sexual Assault: 4-8 Years Older, Felony 2 (two counts)
– Corruption of Minors – Defendant Age 18 or Above, Felony 3
