Hearing for Man Accused of Spitting on Another Man at McDonald’s in Brookville Continued

BROOKVILLE, Pa. (EYT) – A hearing for a man who allegedly yelled obscenities and spit in the face of another man at the McDonald’s in Brookville was continued on Thursday.

Court documents indicate a hearing for 29-year-old Zachary D. Berry, of Baden, Pa., scheduled for Thursday, July 9, was continued at is set to resume at 10:15 a.m. on August 11.

Berry faces the following charges:

– Simple Assault, Misdemeanor 2
– Harassment – Subject Other to Physical Contact, Summary
– Disorderly Conduct Engage In Fighting, Summary

He remains free on $5,000.00 unsecured bail.

The charges stem from an incident that occurred in Brookville in late June.

Details of the case:

According to a criminal complaint, on June 20, Brookville Borough Police were dispatched to the McDonald’s on Allegheny Boulevard for a report of a fight.

According to the complaint, an investigation found that Berry entered the restaurant, approached a known male victim, and began shouting obscenities at the victim for calling 9-1-1 about a fight that had occurred. Berry then allegedly spat in the victim’s face.

The complaint notes the victim drove himself to Penn Highlands Brookville for a medical assessment and treatment for any issues resulting from Berry spitting in his face.

According to the complaint, Berry was also found to have a warrant for failure to pay on an additional disorderly conduct charge from Beaver County.

Berry was arraigned in front of Magisterial District Judge Gregory M Bazylak at 8:45 a.m. on June 20.
