Local Man Awaiting Preliminary Hearing in Aggravated Assault by Vehicle Case

Legal-scales-books-gavel-Image-1024x681[1]NORTH MAHONING TWP., Pa. (EYT) – A DuBois man is awaiting a preliminary hearing in connection with a May 9 traffic accident that left a Punxsutawney man seriously injured.

Punxsutawney-based State police say Robert Fugate, 24, of DuBois, was traveling on Route 119 in North Mahoning Twp, Indiana County, when he allegedly fell asleep.

Police say Fugate’s car crossed the centerline and side-swiped a motorcycle operated by Rodney Kuntz, 63, of Punxsutawney.

Kuntz was flown to Allegheny General Hospital in Pittsburgh for treatment of major injuries. Fugate was not injured.

The following charges have been filed against Fugate in connection with the accident:

  • Aggravated assault by vehicle, Felony 3
  • Accidents Involving Death Or Personal Injury, Felony 3
  • Disregard Traffic Lane (Single), Summary
  • Careless Driving, Summary
  • Reckless Driving, Summary
  • Fail Stop And Give Information Render Aid, Summary
  • Fail To Not Police Of Accident\Injury Or Death, Summary

Bail was set at $25,000 unsecured.

He faces a preliminary hearing before Magisterial District Judge George M. Thachik on November 10.
