Man Allegedly Headbutts, Spits on Cop; Accused of Offering Police Sexual Favors

CaptureNEW BETHLEHEM, Pa. (EYT) – New Bethlehem Borough Police Department says a 24-year-old man has been arrested on 19 Felony counts of Aggravated Assault following an incident that occurred at the police station earlier this week.

Suspect Arrested for Public Intoxication

According to a criminal complaint, around 8:15 p.m. on Monday, February 2, Sergeant Wright, of the New Bethlehem Police Department, was at the station when a known person knocked on the front door. The individual stated that 24-year-old Kyle Allen Trice, of Creekside, Pa., was outside in a vehicle and that he was allegedly drunk.

The known individual advised that Trice, currently on probation, would not get out of the car after being asked by his girlfriend who was driving the vehicle.

Trice allegedly became belligerent when Sergeant Wright made contact with him. Sergeant Wright noticed a strong odor of an alcoholic beverage on Trice’s breath. Wright advised Trice that he was being detained for public intoxication, and he was handcuffed, the complaint states.

Suspect Resists as He Is Shackled to Detention Bench

When Seargant Wright brought Trice inside the New Bethlehem Police Department, Trice allegedly began to tell Wright that he was going to “[expletive] punch him in the face” and stated “just uncuff me.” Wright then attempted to shackle Trice to the detention bench and had to use significant force to subdue him. Trice then pulled away and kicked him, stating that Wright was not shackling him, the complaint continues.

Once shackled to the detention bench, Trice allegedly began yelling profanities at his girlfriend. Trice allegedly began calling her a “fat [expletive] [expletive] and [racial slur].” Sergeant Wright advised Trice to sit down and remain calm, the complaint states.

Suspect Threatens to Shoot Sergeant, Spits on Him

Trice allegedly told Sergeant Wright that he was going to take his gun out of his holster and shoot him “in the [expletive] head.” Sergeant Wright advised Trice that he would be adding a charge of Terroristic Threats, and Trice allegedly began spitting on him. Sergeant Wright informed him that this action constituted Aggravated Assault.

Suspect Uses Head to Rip Clipboards Off Wall

Trice then allegedly kicked both of his shoes off of his feet at Sergeant Wright. Trice then stood up and allegedly began using his head to rip clipboards off the wall and kicked the items with his legs. Then, Trice allegedly spit on Wright again several times as he counted the charges out loud and stated that he is hepatitis positive, the complaint says.

Backup Called to Station; Suspect Headbutts Sergeant

Sergeant Wright called Officer Yough to come to the station for assistance. Sergeant Wright then went over and sat Trice down on the detention bench, and Trice allegedly headbutted him on the right side of the head and kicked Sergeant Wright three times, according to the complaint.

Once Yough arrived at the station, Trice allegedly began spitting on him, also. Trice was then subdued and handcuffed to the detention bench by the middle of the handcuffs he already had on. Trice allegedly continued to spit at the officers for a total of 18 times, which he counted out loud each time. Officer Yough then called the State Police Barracks and requested a trooper to bring a “spit mask,” the complaint states.

Trice then allegedly told Officer Yough that when he and another known male got out of jail, they would find Yough and “take care of him.” Trice allegedly called both officers “[racial slur]” and “[homophobic slur]” several times throughout the remainder of the night, the complaint indicates.

Suspect Requests Hospitalization

Trice then advised that he wanted to go to the hospital, because he was “blacking out.” Clarion Hospital Station 4 was dispatched to the New Bethlehem Police Department. An EMT attempted to evaluate Trice, and Trice allegedly told him to “get the [expletive] away from me you [homophobic slur].” The EMT then advised that the patient had refused treatment, according to the complaint.

Wright Requests Probation Detainer

Sergeant Wright contacted Officer Jory from on-call probation, and a probation detainer was faxed to the station.

Suspect Propositions Officers

According to the complaint, while enroute to the Clarion County Jail, Trice allegedly advised officers that he would perform oral sex on both of them if they would “drop charges.” Trice’s request was denied.

Suspect Awaits Preliminary Arraignment

The following charges were verbally approved by Assistant District Attorney Drew Welsh.

– 1 count of Criminal Mischief-Tamper W/Property, Misdemeanor 3
– 1 count Disorderly Conduct Engage In Fighting, Misdemeanor 3
– 1 count Public Drunkenness And Similar Misconduct, Summary

A preliminary arraignment is scheduled for 2:00 p.m. on February 5 in front of Magisterial District Judge Jeffrey C. Miller.
