PUNXSUTAWNEY BOROUGH, Pa. (EYT) – Charges have been filed against an area man who is accused of stalking, threatening, and harassing a local woman who has a Protection From Abuse (PFA) order against him.
Court documents indicate the Punxsutawney Borough Police Department filed criminal charges against 25-year-old Cody Maines, of Rossiter, on October 11.
According to a criminal complaint, around 5:15 p.m on October 10, Punxsutawney Borough Police received a call from Jefferson County Control requesting that they contact Cody Maines, after receiving a complaint regarding messages from Maines to a known victim.
The victim reported Maines had sent her messages in violation of a Protection From Abuse (PFA) order. Police then contacted Maines, and he reportedly denied sending any messages to the victim, the complaint states.
The complaint indicates police then received another call from the victim indicating Maines had contacted her mother, asking why police were looking for him. The officer informed the victim that Maines asking her mother a question did not violate the PFA but also told the victim he would tell Maines to stop messaging her unless it had to do with their child. Police then called Maines back and told him not to have any further contact with the victim’s mother and also reminded him about the terms of the PFA, under which he was to have no contact with the victim, even via a third party.
Around 10:00 p.m., police received another call from Jefferson County Control after the victim called to report another PFA violation and reported that Maines had called her and threatened to kill her, according to the complaint.
Police then went to speak to the victim and her mother in person. The victim reported that Maines messaged her on Messenger around 9:35 p.m., she ignored it, and he then immediately unsent it. Then at 9:48 p.m., he called her phone from a number he had provided as a contact to police.
The victim told police that when she answered her phone, she heard a man breathing into the phone. She reported that a male voice she recognized as Maines then stated something to the effect of “you’re going to die, (expletive),” and hung up, according to the complaint.
The complaint notes that as she was on the phone, the victim was able to get a recording of Maines calling and telling her this.
The victim’s mother reported that she also received a message from Maines around 9:36 p.m. in which Maines stated that if he goes to jail, his family will “take care of her.” When she asked Maines if that was a threat, he reportedly replied, “Nah, you (expletive),” and said he did “not deserve this.” She then blocked his number and heard the victim yelling for her to come upstairs because Maines was calling her phone. She then recorded Maines calling the victim on her phone, according to the complaint.
The complaint indicates Maines is currently on probation for a previous violation of the PFA order, which was finalized on October 1, 2021.
Maines was arraigned in front of Magisterial District Judge Gregory M Bazylak at 12:57 a.m. on October 11, on the following charges:
– Stalking – Repeatedly Communicate To Cause Fear, Misdemeanor 1
– Terroristic Threats With Intent To Terrorize Another, Misdemeanor 1
– Harassment – Comm. Repeatedly in Another Manner, Misdemeanor 3
Unable to post $20,000.00 monetary bail, he was lodged in the Jefferson County Jail.
A preliminary hearing is scheduled for 10:30 a.m. on November 9 with Magisterial District Judge Jacqueline J. Mizerock presiding.
Court documents indicate Maines stood for an Indirect Criminal Contempt (ICC) hearing on contempt for violation of order charges on October 14.
