Punxsy Man Accused Sending Photo of Genitals to Minor on Snapchat

PUNXSUTAWNEY BOROUGH, Pa. (EYT) – Charges have been filed against a Punxsutawney man who allegedly sent a photo of his genitals to a minor on Snapchat.

Court documents indicate the Punxsutawney Borough Police Department filed criminal charges against 29-year-old Benjamin S. Sarvey on Monday, May 10.

According to a criminal complaint, Punxsutawney Borough Police received a Childline report on May 3 indicating that Benjamin Sarvey sent a photograph of his genitals to a minor female victim via Snapchat.

When the victim was interviewed, she reported that about three weeks prior, Ben Sarvey had asked her to add him on Snap Chat. She reportedly said “things were fine” when she and Sarvey began communicating through the app until he began saying “weird” things to her, according to the complaint.

The victim reportedly told police that at one point, Sarvey sent her a photo of his legs in a bathtub and said “I would show you, but your boyfriend would get mad.” Then a few nights later, she put up a photo on her “group” of her doing “kissing lips,” and Sarvey commented that he wished he could kiss them. Also, when she shared with her “recents” a photo that was only her eyebrows, forehead, and showerhead, Sarvey reportedly responded, “will you show me more.”

According to the complaint, when the victim then received a photo from Sarvey, which showed him holding his genitals in his hand, she told her brother what happened, and she blocked Sarvey on Snapchat.

The victim also told police that Sarvey sent her several messages stating that he was sorry and asking if she was mad at him, but she had no further contact with him, the complaint notes.

Police then contacted Sarvey about the allegations on May 4.

According to the complaint, Sarvey initially began talking about a separate case involving the Pennsylvania State Police and stated that he “sent the video” to another victim “by mistake.” When police clarified they wanted to talk about the Snapchat photo he sent to the minor victim, Sarvey reportedly denied he did anything and wanted to press charges against whoever made the claim for a false complaint. He was then asked to provide written statements from his witnesses but had failed to do so as of May 10.

The following charges were filed against Sarvey through Magisterial District Judge Jacqueline J. Mizerock’s office on May 10:

– Photograph/Film/Depict on Computer Sex Act – Knowingly or Permitting Child, Felony 2
– Child Pornography, Felony 3
– Corruption Of Minors – Defendant Age 18 or Above, Felony 3 (two counts)
– Corruption Of Minors, Misdemeanor 1 (two counts)

A preliminary hearing is scheduled for 10:45 a.m. on June 8, with Judge Mizerock presiding.
