36-Year-Old Man Accused of Raping 12-Year-Old Girl in Sykesville

handcuff-300x225WINSLOW TOWNSHIP, Pa. (EYT) – According to court documents, a 36-year-old DuBois man has been accused of raping a 12-year-old girl in Sykesville.

Court documents indicates 36-year-old Eric Stephen Nelson, of DuBois, faces rape and drugs charges stemming from an incident that allegedly occurred in the summer of 2013.

According to a Criminal Complaint, this incident occurred at Nelson’s former residence which is located on Sykes Street Extension, Winslow Township, Jefferson County.

The Criminal Complaint states that on July 30, 2014, at approximately 10:20 a.m., the 12-year-old victim was interviewed by a Forensic Interviewer at the Western PA CARES for Kids located in Brookville. The victim related that she went over to Nelson’s house on her bicycle sometime in the summer of 2013 because she was going to help a family member move into an apartment nearby. The victim indicated that a family member was good friends with Nelson, so there was no problem with her staying.

The Complaint says the victim was watching television in the living room sitting on the couch when Nelson got her high on drugs. The victim said she smoked marijuana from a bong, and Nelson allegedly gave her half a pain pill.

The victim related that she went back to Nelson’s bedroom on the bed to sleep because she preferred it over the couch. Five minutes later Nelson allegedly came into the room and began rubbing her leg. She said that she told him to stop. Nelson was wearing pajamas, and she was wearing a shirt and pants. According to the victim, Nelson got undressed and allegedly got on top of her. She said she was positioned flat on her back on the bed. She said she asked him what he was doing when he got on top of her. He then allegedly took her clothes off.

According to the complaint, the 12-year-old victim said that she was too high to do anything, or even move. She said that he had anal intercourse with her, and that he allegedly told her not to tell anyone or he would kill her. For the remainder of the night, she slept on the couch. When she woke up in the morning, she went into his bedroom grabbed her hoodie, and left.

The Complaint states that on October 18, 2014, at around 4:00 p.m., Trooper Berta, of PSP DuBois, was able to contact Nelson via phone and interview him. When Berta spoke to him on the phone, he was allegedly asking a lot of questions, such as “What is the difference between rape and consensual sex?” Berta said he asked “If he said he did it, would he go to jail?” Berta told him it’s always best to cooperate and be honest. Nelson informed Berta that all he had on his record was receiving stolen property. He also allegedly related that “It was not intentional, but yes it happened.”

The Criminal Complaint indicates on October 18, 2014, at approximately 4:30 p.m., Berta interviewed Nelson in a parking lot beside Sheetz near Brady Street, in DuBois. Berta indicates that Nelson understood that he was not in custody, that his statement that he was about to provide was completely voluntary, and that he was free to leave at any time. Nelson related that he lied at the first interview at the station on August 11, 2014, because he was scared. He allegedly related that it is possible he had sex with the victim, but he did not remember because of his medication. He related that it was around 11:00 p.m. or midnight when he took his medication – 300 mg of Seroquel. He related that she was on his bed using his phone, and he told her when she was done to go to the other room because he was going to sleep.

When he woke up, she was still there in bed with him. He allegedly related that they apparently had consensual sex. He denied giving her any drugs.

Based on the evidence provided, DuBois-based State Police filed the following charges against Nelson:

– Rape of Child, Felony 1
– Statutory Sexual Assault: 11 Years Older, Felony 1
– Involuntary Deviate Sexual Intercourse W/Child, Felony 1
– Indecent Assault Person Less than 13 Years of Age, Misdemeanor 1
– 2 counts of Manufacture, Delivery, or Possession With Intent to Manufacture or Deliver, Felony
– Corruption Of Minors – Defendant Age 18 or Above, Felony 3
– 2 counts of Intentional Possession of Controlled Substance By Person Not Registered, Misdemeanor
– Use/Possession Of Drug Paraphernalia, Misdemeanor
– Corruption of Minors, Misdemeanor 1

Magisterial District Judge David B. Inzana has been assigned to the case.

A date for the Preliminary Hearing has not been provided.
