Summerville Man Faces Felony Sexual Assault of Minor Charges

PINECREEK TWP., Pa. (EYT) – A Summerville man is facing felony sexual assault and related charges stemming from an alleged incident that occurred in a pull-off area located off State Route 28, north of Brookville, in Pinecreek Township, Jefferson County.

According to court documents, Punxsutawney-based State Police filed charges against 21-year-old Damon Allen Hepburn, of Summerville.

According to a criminal complaint, around 2:58 p.m. on November 6, Trooper Julie Clark, of Punxsutawney-based State Police, interviewed a female juvenile who said that “she had consensual sex with Damon Allen Hepburn in the back seat of his vehicle. She stated this occurred sometime between 11:00 p.m. on September 17, 2015, and 3:45 a.m. on September 18, 2015.”

The complaint states that Trooper Clark contacted Hepburn on November 6 concerning the investigation, and he agreed to come to the PSP Punxsutawney station around 1:00 p.m. on November 7. Around 1:17 p.m. on November 17, Hepburn contacted Trooper Clark and asked again why she needed to speak to him. He told Trooper Clark that “he knows he does not have to speak to her,” and Trooper Clark “told him that was his choice.”

Around 2:31 p.m. on November 20, Hepburn called Trooper Clark asking if she still needed to speak to him. She advised him that the District Attorney authorized filing charges, and “if he wanted to speak to her, he could, but it was his decision. He declined,” the complaint continues.

Trooper Clark filed a criminal complaint on December 14, 2015, with Magisterial District Judge Gregory M. Bazylak.

Hepburn was arraigned at 2:30 p.m. on December 15 in front of Judge Bazylak.

He faces the following charges:

Bail was set at $25,000.00 unsecured.

A preliminary hearing is scheduled for 1:30 p.m. on January 7, 2016, with Judge Bazylak presiding.
