Police: Couple Sets Man Up for Sex With Minor

PUNXSUTAWNEY BOROUGH, Pa. (EYT) – Three people are facing criminal charges following an investigating into an alleged statutory sexual assault in Punxsutawney Borough.

Court documents indicate the Punxsutawney Borough Police Department on June 23 filed criminal charges against 22-year-old Brian W. Roller Jr., of Rossiter; 24-year-old Adalida Marie Hayes, of Punxsutawney; and 21-year-old Michael Alex Sharp, of Punxsutawney.

According to a criminal complaint, on May 15, Punxsutawney Borough Police initiated an investigation into a report of a sexual assault.

According to the complaint, Michael Sharp reported a known juvenile female had sexual intercourse with a 22-year-old man by the name of Brian Roller Jr.. Sharp allegedly reported they had sex at his Beyer Avenue apartment and told police he had the bed sheets and comforter bagged up already.

Police then proceeded to the apartment to speak with Sharp and his wife, Adalida Hayes.

The complaint states the couple reported the incident occurred upstairs in the bedroom and bathroom and said the victim told them she and Roller had sex on the bed and in the bathroom. They also provided police with two white plastic bags containing the bed sheets and the comforter Roller and the victim allegedly had sex on.

Police then received a call from the Punxsutawney Area Hospital in regard to the rape kit that was requested.

According to the complaint, the doctor reported the victim admitted to having consensual sex with Roller and did not want testing done.

Police then spoke to the victim, who stated she and Roller had sex three times since May 10. The complaint notes the victim later asked if it was necessary for her to come in for questioning as she did not want Roller arrested, and later filled out a statement form indicating as much.

The victim reportedly told police she was at Sharp and Hayes’ residence and told them and Roller that she was going upstairs to get a shower, and they told her to leave the door unlocked. She said Roller then came in the room and got in the shower with her naked, then began to have sex with her.

The complaint notes the victim also reported that as they were having sex, Sharp was outside the bathroom door pounding on the door and yelling (obscene gestures). The victim also stated that when she went back downstairs, she asked Sharp and Hayes “if this was planned,” and they both stated that it was. She also allegedly stated that Roller knew her age before they had sex, according to the complaint.

Police then spoke to Sharp about the incident. He reportedly stated he was under the impression that Roller was the same age as the victim. He also told police that when Roller took the victim and went upstairs to a bedroom, he told them not to have sex, the complaint indicates.

While the police were speaking with Sharp, he was “consistently talking with his wife and he appeared to be excited and nervous as his voice would crack,” according to the complaint.

Roller was arraigned in front of Magisterial District Judge Jacqueline J. Mizerock at 9:10 a.m. on June 24, on the following charges:

– Statutory Sexual Assault: 4-8 Years Older, Felony 2 (three counts)
– Aggravated Indecent Assault Without Consent, Felony 2 (three counts)
– Aggravated Indecent Assault – Comp. Less Than 16, Felony 2 (three counts)
– Corruption Of Minors – Defendant Age 18 Or Above, Felony 3 (three counts)
– Endangering Welfare of Children – Parent/Guardian/Other Commits Offense, Misdemeanor 1 (three counts)
– Indecent Assault-Without Consent Of Other, Misdemeanor 2 (three counts)
– Indecent Assault Person Less 16 Yrs Age, Misdemeanor 2 (three counts)

He remains free on $5,000.00 unsecured bail.

A preliminary hearing is scheduled for 9:30 a.m. on August 6, with Judge Mizerock presiding.

The following charges were filed against Sharp and Hayes through Magisterial District Judge Jacqueline J. Mizerock’s office on June 23:

– Corruption Of Minors – Defendant Age 18 Or Above, Felony 3 (three counts)
– Endangering Welfare of Children – Parent/Guardian/Other Commits Offense, Misdemeanor 1 (three counts)

Preliminary hearings are scheduled for 9:45 a.m. and 10:00 a.m., respectively, on August 6, with Judge Mizerock presiding.
