Victim Punched, Kicked After Winking at Woman; Two Face Aggravated Assault Charges

arrestedPUNXSUTAWNEY, Pa. (EYT) – Two Punxsutawney men are facing charges after they allegedly assaulted a known man, causing him injury.

According to a criminal complaint, police spoke with a woman on October 1 regarding an incident that took place at her residence at around 1:00 a.m. on September 26.

The woman told police she was outside drinking beer with her husband and several others, including Jeremy Lynn Newcome, 35, and Jesse D. Pearce, 32, both of Punxsutawney, and the male victim, the complaint states.

The woman said she went inside the residence after someone else left to go home, and the back door was open and she could hear her husband asking the victim if he had been winking at her before she saw her husband shove the victim on the porch but “did not see who punched who first,” the complaint continues.

After a short time, the woman went back outside, where she saw the victim on the ground and her husband was helping him into a chair. The victim had blood coming from his ear, and she drove him to the hospital for treatment of his injuries, according to the complaint.

Police spoke with the woman’s husband, who said he and the victim went to get beer and returned to his residence. A verbal argument began between him and the victim over the victim winking at his wife, the complaint states.

The known man and the victim shoved one another before Newcome and Pearce allegedly began punching the victim until he fell on the ground, then they began kicking him. The known man admitted that he kicked the victim as well but was not sure how many times or to what part of his body. This assault allegedly continued until a known woman who was also at the residence pulled Newcome off of the victim, the complaint states.

The known woman allegedly asked the known man to “take the fall for the assault because Jeremy and Jesse are on probation,” the complaint states.

The known man said on September 27, the day after the assault, Newcome and Pearce allegedly came to his house to ask him what was going on because “they were just sticking up for him,” the complaint continues.

Police received a medical report from Punxsutawney Area Hospital on October 2 which showed four specific injuries to the victim, including two bone fractures, a separated right shoulder, and an injury to the left ear, according to the complaint.

According to online court documents, Newcome and Pearce each face the following charges:

  • Aggravated Assault – Felony 1
  • two counts of Simple Assault – Misdemeanor 2
  • Recklessly endangering another person – Misdemeanor 2
  • Disorderly conduct engaging in fighting – Misdemeanor 3
  • Disorderly conduct which is hazardous or physically offensive – Misdemeanor 3

A preliminary hearing has been scheduled for 9:30 a.m. on December 22 before District Judge Robert Chambers.
