Brookville Man Allegedly Punches Woman After Argument Over Urinating on Toilet Seat

crime-newsPINE CREEK TWP., Pa. (EYT) – A Brookville man faces assault charges stemming from an alleged altercation that occurred on Sarvey Lane, in Pinecreek Township, Jefferson County.

According to court documents, Punxsutawney-based State Police filed charges against 31-year-old Joshua A. Popson, of Brookville.

According to a criminal complaint, the incident occurred on December 27 as Joshua A. Popson and the victim were asleep at the above described location; the victim woke up Popson, and a verbal altercation turned physical.

The complaint indicates that the victim stated she and Popson came home around 2:30 a.m. and “(Popson) was highly intoxicated (20+ beers).” They both went to bed and the victim “woke up at approximately 4:45 a.m. to go (urinate).”

The complaint states that when the victim came back to bed, she heard Popson “moaning….so she woke him up. She told him to go to the bathroom but make sure to lift the toilet seat.”

According to the complaint, “while in the bedroom, (the victim) did not hear the toilet seat raise, so when (Popson) exited the bathroom, she went inside…and saw where (Popson) (urinated) on the toilet seat and on the floor. She then yelled at him about going in later and sitting in his (urine).”

A verbal altercation ensued and Popson raise his middle finger and put it in the victim’s face. The victim knocked the hand away. According to the victim, “(Popson) said ‘You think you can do that again?’ (Popson) put his middle finger in the victim’s face a second time. The victim knocked the hand away again, and then (Popson) punched the victim five to six times with a closed fist in the face,” the complaint states.

Trooper Steven Johnson, of PSP Punxsutawney, observed the following injuries on the victim: abrasion on left eye lid/swollen/bruised; scratch on left ear lobe; two cuts on lower lip; and right cheek and jaw area swollen, the complaint continues.

Based on his investigation, Trooper Johnson requested a warrant of arrest be issued for Popson.

Popson was arraigned at 5:00 p.m. on December 27 in front of Judge Gregory M. Bazylak.

He was charged with the following offenses:

  • Simple Assault, Misdemeanor 2
  • Harassment – Subject Other to Physical Contact, Summary

Bail was set at $25,000.00 unsecured.

A preliminary hearing is set for 11:00 a.m. on January 6 with Judge Bazylak presiding.
