Brookville Man Faces Charges for Pulling Gun on Neighbor During Dispute

BROOKVILLE BOROUGH, Pa. (EYT) – A Brookville man is facing criminal charges after he allegedly pulled a gun and pointed it at his neighbor during a dispute on Saturday.

Court documents indicate the Brookville Borough Police Department filed criminal charges against 25-year-old Paul McManigle.

According to a criminal complaint, around 5:01 p.m. on October 10, Brookville Borough Police were dispatched to a residence on Taylor Street for a report of a person who had a gun pointed at him by a neighbor.

At the scene, police found Paul McManigle outside with his conceal carry permit and change of address card.

Police also went to speak to the victim who reported the incident.

According to the complaint, the victim told police he was walking through his backyard and noticed there was wood piled against his fence. He reportedly yelled across the fence to the neighbor to move the wood off the fence and McManigle responded “(expletive) you.”

The victim told police he then asked McManigle “you want to start something?” and when he turned to look toward the fence, McManigle was pointing a gun at him, the complaint states.

The victim reported his mother was with him, walking through the yard, and was frightened by the incident, the complaint notes.

Police then spoke to the victim’s mother who reported the victim did yell across the fence about the wood. She stated she did not see the gun, the complaint states.

Police also spoke with another witness at the scene.

The other witness reported the victim yelled at McManigle to move the wood away from the fence, and McManigle responded “(expletive) you.” The witness said he heard the victim say “you want to start something,” but did not see McManigle pull the gun out, the complaint continues.

When police arrived at the scene, McManigle informed them he had placed the firearm in the house and described where to find it, the complaint notes.

He was also interviewed about the incident and reportedly stated he and his neighbor were arguing over wood stacked on the neighbor’s fence. McManigle told police that during the argument, he pulled his firearm from his holster on his hip because he was “unsure what (the victim) would do next,” the complaint states.

McManigle demonstrated that he pulled the firearm up to a firing position, then down and away at a low ready position.

According to the complaint, McManigle denied being in fear for his life or of serious bodily injury and simply stated he was not sure what the victim would do. McManigle also acknowledged the victim never left his property, the complaint states.

The firearm was identified as a Walther PK380, made by Smith and Wesson. The firearm did have a magazine in the weapon with no round in the chamber at the time of contact. The weapon’s safety switch was rotated to the fire position, as well, the complaint indicates.

McManigle acknowledged he was aware his action was dangerous and could result in someone being hurt or killed, according to the complaint.

Police also spoke further to the victim who reported he was not worried that McManigle would shoot him but was more concerned McManigle might accidentally shoot his mother, who was behind him when the incident occurred, the complaint states.

McManigle was arraigned in front of Magisterial District Judge Gregory M. Bazylak at 9:15 a.m. on October 11, on the following charges:

– Aggravated Assault – Attempts to cause or causes Bodily Injury with Deadly Weapon, Felony 2
– Terroristic Threats With Intent To Terrorize Another, Misdemeanor 1
– Recklessly Endangering Another Person, Misdemeanor 2 (two counts)
– Simple Assault, Misdemeanor 2
– Disorderly Conduct Engage In Fighting, Misdemeanor 3

Unable to post $10,000.00 monetary bail, he was lodged in the Jefferson County Jail.

A preliminary hearing is scheduled for 2:15 p.m. on November 23, with Judge Bazylak presiding.
