Appeal of 90-Year-Old Man’s Sexual Assault Conviction Rejected by Supreme Court

HARRISBURG, Pa. (EYT) – An appeal filed to the Supreme Court in the case of a 90-year-old Indiana man convicted on sexual assault charges has been rejected.

According to an article posted by WCCS Radio, the State Supreme Court declined to take up 90-year-old Ralph Duncan‘s case without comment.

Duncan pleaded guilty to one count of sexual assault and two counts of witness intimidation in 2012 when he was 84 years old. He allegedly molested a teenage girl over a three-year period beginning when she was 13 and attempted to prevent other family members from reporting the abuse.

Duncan, who is currently serving 8-and-a-half to 30 years in state prison for the assaults, appealed to the Supreme Court after Superior Court ruled against him last year. The Superior court declined to take up the case due to a failure to file an appeal on time, as he filed two years too late.

A second petition was also denied as Duncan failed to address the timeliness issue. He instead submitted a single page request in which he attempted to convince the court to take up the appeal based on a “newly discovered fact”, without actually disclosing what that fact was.

Duncan also attempted to claim ineffective counsel by his trial attorney and was denied again.
