GANT: DuBois Man Waives Hearing in Assault Cases

CLEARFIELD, Pa. (GANT) – A DuBois man accused of punching employees at an area hospital emergency room and assaulting an elderly man at an assisted living facility was scheduled for preliminary hearings Wednesday.

Brandon L. Mottern, 39, was charged with aggravated assault and simple assault in relation to his actions at Penn Highlands DuBois on July 23.

Last week Sandy Township police charged him with simple assault, disorderly conduct and resisting arrest, all misdemeanors, as well as summary harassment.

According to the affidavit of probable cause in the first incident, witnesses said Mottern walked out of his room towards staff “aggressively” before punching a staff member in the head twice.

Once they were separated, he then reportedly reached out, grabbed the hair of both the victim and a nurse, and began pulling.

The assault was witnessed by several staff members.

In the second case, police were called to an assisted living facility for individuals with intellectual disabilities in Sandy Township to investigate an assault on Oct. 19.

The victim, an elderly man who is mentally challenged, told the officers that Mottern pushed him in the living room and now his back hurts.

A staff member and witness said the victim “hit the ground with extreme force,” and was going to be taken to the hospital to evaluate his ribs and back, according to the affidavit of probable cause.

An officer noted that there were several holes in the wall where Mottern had punched the wall and he had completely torn off the railing on the front porch, he noted in the report.

When police took him into custody, Mottern allegedly attempted to pull away several times while resisting their attempts to handcuff him.

After a short struggle, he was apprehended and placed in the patrol car. The officers used two sets of handcuffs, police said.

Another witness told investigators that when Mottern left the facility and walked down the street, he was “striking mailboxes of the neighbors and yelling profanities.”

During centralized court on Wednesday, he waived his right to hearings in both cases, sending them on to the county court for further disposition. He is incarcerated on $5,000 bail for each case.
