Details of the case:

According to a criminal complaint, on the morning of January 2, a Punxsutawney-based State Trooper traveling north on Indiana Street in Punxsutawney observed a white sedan traveling south with an expired inspection.

The sedan was followed and stopped by police on Indiana Street. The state trooper approached the vehicle and communicated with Stefon Everet Bogacki, the driver of the vehicle, and a known male. The trooper informed Bogacki of the reason for the stop and asked for his license, registration, and insurance, according to the complaint.

Bogacki was informed his license was suspended, and while interacting with him, the trooper noticed Bogacki’s eyes to be “bloodshot, watery and droopy, his speech to be thick, mildly mumbled, and slurred, and movements to be slow and lethargic,” the complaint indicates.

The trooper also noticed a sticker on the center console of the car in the shape of a marijuana leaf, marked as Weedville, Pa., the complaint states.

Bogacki was asked about the sticker and became nervous, according to the complaint.

He consented to having his car searched, and after he was brought outside, he related to the trooper he had a “weed pipe” in his backpack and a marijuana “roach” in the center console of the vehicle, the complaint notes.

The search of the car yielded a green backpack, two locked cases, one black and silver and one black and green with a zipper, and a black zipper case.

The following items were found in each container, according to the complaint:

Black zipper case:

  • One clear, glass smoking device wrapped in aluminum foil and containing suspected methamphetamine.
  • One clear plastic baggy containing approximately three grams of suspected methamphetamine.
  • Two small, clear plastic baggies containing suspected drug residue.
  • One pink plastic baggy containing suspected drug residue.
  • One small plastic straw containing suspected marijuana residue.
  • One metallic scraper tool containing suspected drug residue.

  • Miscellaneous plastic baggies in all sizes.
  • One plastic container containing suspected drug residue.
  • One green colored “Nectar Collector.”
  • One pocket scale.

  • One black Grassroots smoking device and silver metallic scraper tool.
  • One blue rubber container containing suspected THC wax.
  • One white pill capsule marked 377 and identified as Tramadol Hydrochloride.
  • One glass smoking device with a purple covering containing suspected methamphetamine residue.
  • One silver metallic scraper tool containing suspected drug residue.
  • One plastic baggy marked with green marijuana leaves containing suspected LSD wrapped in foil.

Green and black case:

  • Approximately 61.4 grams of marijuana separated into four separate plastic baggies.

Green backpack:

  • One Cali Crusher Slick metallic grinder containing marijuana residue.
  • Four metallic scrapers containing burnt drug residue.
  • One pack of RAW Tips Rolling Papers.
  • One 78mm cigarette roller.
  • Two Terpene Shield packets.
  • One orange packet of E-Z Wilder rolling papers.
  • One blue-colored smoking device containing suspected methamphetamine residue.
  • One black straw containing drug residue.
  • One small plastic baggy containing approximately 1.5 grams of suspected methamphetamine.
  • One orange in color glass smoking device containing suspected drug residue.
  • One metallic cylinder container containing suspected marijuana residue.

After arriving at PSP Punxsutawney, Bogacki was read his Miranda Warnings and asked if he was aware of the black zipper case. He said he was not aware of the case or its contents. He was also asked about the locked containers, to which Bogacki said the green and black case was his but that the black and silver case was given to him by an unknown person and he did not know what it contained.

Bogacki provided the combination to the green and black case but did not know the code for the other case. Troopers successfully opened both cases with the same combination Bogacki gave them, the complaint states.

Charges were filed in Judge Mizerock’s office on February 7.
