Punxsy Man Accused of Attacking Victim Following Vehicle Accident Due in Court Next Week

PINE CREEK TWP., Pa. (EYT) – A Punxsutawney man is facing a hearing next week on charges related to an incident where he allegedly attacked and struck a man who hit his vehicle.

Court documents indicate 46-year-old David Andrew Phillips, of Punxsutawney, is scheduled to stand for a preliminary hearing in front of Magisterial District Judge Gregory M. Bazylak at 9:30 a.m. on Thursday, November 21, on the following charges:

– Simple Assault
– Harassment – Subject Other to Physical Contact, Summary

The charges stem from an incident that occurred in Pine Creek Township in early September.

According to a criminal complaint, around 12:01 a.m. on September 1, 2019, a known victim was doing donuts in a field and lost control of his vehicle, which caused him to hit David Andrew Phillips‘s vehicle.

According to the complaint, Phillips thought the driver of the vehicle hit his wife, due to her standing next to the vehicle. Phillips then allegedly pulled the victim out of his vehicle and struck him several times in the face with a closed fist.

The complaint notes the victim suffered redness to the right and left sides of his face, redness to both eyes, black and blue eyes, and redness to his neck. The injuries were photographed as evidence.

The charges were filed against Phillips through Magisterial District Judge Gregory M. Bazylak’s office on October 1 and Aa certified summons was issued to Phillips on October 2.
