PolicePUNXUSTAWNEY BOROUGH, Pa. (EYT) – Punxsutawney Borough Police responded to apartments on Sycamore Street for the report of a man threatening to shoot people in the complex.

According to court documents the following Punxsutawney men are facing charges following two incidents at the Sycamore Street apartment complex:

– 34-year-old Virgil Ryan Eakin;
– 41-year-old Mark Joseph Pavlosky;
– 28-year-old Corey Wood; and
– 19-year-old Nathan J. Johns.

First Incident at Sycamore Street Apartment Complex

According to a criminal complaint, Punxsutawney Borough Police were dispatched to an apartment on Sycamore Street around 10:07 a.m. on July 8 for a report of a man threatening to shoot people in the apartment complex.

At the scene, Nathan Johns reportedly told police that Virgil Eakin had displayed a handgun and threatened to shoot him. Johns said he was in Eakin’s apartment when Eakin displayed what appeared to be a black 9mm semi-automatic handgun. Eakin said he was “not happy” and threatened to shoot the victim if he didn’t leave the apartment immediately.

The complaint notes Johns reported he didn’t have any previous confrontation with Eakin and had only gone to Eakin’s apartment to retrieve belongings he had left there.

Police then went to speak to Eakin.

According to the complaint, when police knocked at his door and identified themselves, Eakin began yelling obscene language and failed to come to the door. The officer then contacted Chief Conrad to respond, as Eakin was becoming more agitated and yelling.

The complaint states that after approximately three to five minutes, Eakin came to the door and exited the apartment. He was then searched and was not found to be in possession of any weapons.

According to the complaint, when asked about the incident, Eakin said he did not have a weapon in his apartment. However, he refused to allow police into the apartment until they offered to get a warrant. He then allowed them inside and told them he had a pellet gun in his reclining chair.

The complaint states Chief Conrad pulled the pellet gun from the chair and found it was black and looked “like a real gun.”

The following charges were filed against Eakin through Magisterial District Judge Jacqueline J. Mizerock’s office on July 15:

– Terroristic Threats With Intent To Terrorize Another, Misdemeanor 1
– Disorderly Conduct Engage In Fighting, Misdemeanor 3
– Harassment – Subject Other to Physical Contact, Summary

A preliminary hearing is scheduled for 10:00 a.m. on August 6, with Judge Mizerock presiding.

Second Incident at Sycamore Street Apartment Complex

According to a second complaint, Punxsutawney Borough Police were dispatched to a residence on Sycamore Street around 12:25 a.m. on July 10 for a report of an altercation involving four men: Virgil Ryan Eakin; Mark Joseph Pavlosky; Corey Wood; and Nathan J. Johns.

Eakin was observed to have sustained injuries and a medic unit was summoned to the scene, the complaint notes.

Wood and Pavlosky were not present when police arrived, but Pavlosky returned a short time later, after leaving to “cool off,” and Wood was found hiding in shrubs across the street, according to the complaint.

Police then obtained statements from witnesses to the incident.

The complaint states the first witness reported he heard yelling and saw Eakin in the parking lot with two other men and he walked over to walk with Eakin back to his apartment. He told police that the men then came running across the parking lot and “jumped” Eakin.

A second witness stated that Eakin “got jumped” from behind by three men. However, the witness did not know the men’s names.

According to the complaint, a third witness stated she woke up and heard people fighting outside, then looked out and saw three people “beating up” Eakin. She reported she recognized one of the men to be Nathan Johns.

A fourth witness told police that he saw three people “beating up” Eakin, and one of the three men then challenged him for “sticking up” for Eakin.

The complaint states that when questioned about the incident, Pavlosky reported he came out of his apartment, and Eakin called him a rat, and he then approached Eakin to speak with him. He told police that Eakin then “jumped on him.” Pavlosky said he then struck Eakin three times in the face, and Eakin struck him back.

According to the complaint, Johns refused to make a statement.

The complaint notes Eakin was transported to Punxsutawney Area Hospital by Jefferson County EMS.

He was later questioned about the incident and reported he was confronted about “something that had nothing to do with him (Wood).” He told police he walked away, and Pavlosky and Johns then joined Wood, and Pavlosky struck him in the back of his head with his fist. He reported they both then tumbled down a hill and Pavlosky continued to hit him. He said Johns also hit him once, and Wood struck him in the back of the head. He noted that “things got hazy” then and said if it weren’t for the first witness, he “would have gotten beaten even worse.”

Eakin sustained injuries to his right knee, his left elbow, and his face.
