Rimersburg Man Awaiting Trial for Alleged Sexual Assaults on Young Girls

CLARION, Pa. (EYT) – A Rimersburg man is awaiting a trial stemming from 16 sexual-related charges that include nine felonies for alleged offenses against two female juveniles.

According to court documents, on November 20, 2014, New Bethlehem Borough Police arrested 21-year-old Brady Divins, of Rimersburg, following an investigation of two cases that occurred in the summer of 2012 involving two female juveniles.

Clarion OES Receives Call from First Victim’s Mother

According to a criminal complaint, around 7:26 p.m. on Tuesday, March 18, 2014, Officer Robert L. Seyler was contacted via dispatch to call Clarion Operation of Emergency Services (Clarion OES). OES advised Seyler that they received a call from a person who stated that her daughter had been sexually assaulted two summers ago and that she had just been made aware of it. OES advised Seyler that the suspect was approximately 20-years-old at the time of the assault and that the victim was 12 or 13-years-old at the time. Seyler advised OES that he would report to the victim’s residence and speak to the family.

Police Begin Initial Investigation of Alleged Sexual Assault

Officer Seyler went to the victim’s residence, and she told him that the suspect’s name was Brady Divins. The victim advised Seyler that she and Divins had been at the Sligo Pool in the summer of 2012 in either July or August. She said that she and Divins left the Sligo Pool and walked to an abandoned railroad track in Sligo.

The victim told Seyler that once they arrived at the abandoned railroad tracks, they came to a bridge near Heeter Lumber in Sligo. She said that Divins got “touchy feely” with her. She advised that she had told Divins five to ten times that she needed to go home, but he would not let her. She said that at one point she attempted to walk away, and Divins picked her up off of her feet and carried her back to the bridge.

Seyler requested the victim to give a written statement in lieu of completing the incident verbally, because she had become visibly upset.

New Bethlehem Borough Police Sergeant Roger Wright Assigned Case – March 19, 2014

On March 19, 2014, Sergeant Roger E. Wright, of the New Bethlehem Police Department, was handed the case by Officer Robert Seyler that involved the alleged sexual assault. Wright scheduled a Forensic Interview on March 28, 2014, at 9:08 a.m. at the Children and Youth Services in Kittanning.

Forensic Interview with Victim #1 on March 28, 2014

According to the criminal complaint, in the Forensic interview, victim #1 advised she was at the Sligo Pool where Divins worked as a Life Guard. When he got off work, they left the pool walking, until they came to the bridge behind Heeter Lumber, and they sat down together.

She continued to tell how she and Divins sat down on the bridge, and one of her shoes fell off into the creek, and she went down to retrieve it. While she was retrieving the shoe, Divins came down and sat her onto a ledge and began to kiss her. Divins then began to touch her under her shirt and in her pants. Victim #1 told Divins that she had to go home, and he picked her up and sat her back on the ledge telling her that “you keep saying ‘no,’ but you mean ‘yes.'”

Victim #1 then stated that Divins took his pants off, and then forced her to perform oral sex and engage in other sexual acts. Victim #1 said that she heard rumors of other girls that Divins had done the same thing with. She then gave names of three juvenile females.

Interview at New Bethlehem Police Department with Victim #2

In an interview at the New Bethlehem Police department, victim #2 relayed that in the summer of 2012 Divins had forced her to give him oral sex on two separate occasions. A Forensic Interview was scheduled for April 9, 2014, at 10:00 a.m.

Forensic Interview with Victim #2 on April 9, 2014

The criminal complaint states that during the Forensic Interview, victim #2 indicated that two summers ago (summer of 2012) she was at the Sligo Pool with Divins and his friend. The pool was having a slow day, so Divins decided to leave work early.

Victim #2, Divins, and his friend left the pool and decided to go fishing. Victim #2 advised that they arrived at an area that had two ponds and that Divins’ friend went to the other pond to fish leaving victim #2 and Divins at the first pond. Victim #2 stated that she and Divins began to kiss, and Divins tried to push her down onto her knees and asked for oral sex, but she refused.

Victim #2 stated after that they left the ponds and went to Divins’ residence. Divins’ friend left Divins residence leaving her and Divins alone at the residence on Colerain Street in Sligo. Victim #2 continued to say that she was laying on the couch watching television in Divins’ living room, and Divins climbed on top of her and began touching her breasts. Divins then got up and pulled his shorts down and tried to get her to perform oral sex. Victim #2 said that she told Divins “no,” but that he grabbed her by the back of her hair and forced her to perform the sexual act.

Victim #2 continued on and discussed the second occasion where she was at Divin’s residence hanging out with a known female. She said that she and Divins were in his bedroom watching a movie on his bed when he put his hands down her pants forcefully and entered her private area. Divins then pulled down his pants and oral sex was performed a second time by victim #2.

Sergeant Wright Interviews Witness

On April 28, 2014, Sergeant Wright made contact with Divins’ friend and requested that he come to the New Bethlehem Police Department for an interview. During the interview, Divins’ friend told Sgt. Wright that he remembered going to the ponds in the summer of 2012 with victim #2 and Divins.

The witness relayed that he went to a separate pond to fish and left victim #2 and Divins at the other pond, where he looked over and saw them kissing. The witness then relayed that he drove victim #2 and Divins back to Divins’ residence and dropped them off. The witness then told Sgt. Wright that he saw Divins and asked him what happened. Divins allegedly told the witness that victim #2 started to give him oral sex, and after a little while, he stopped it because it was wrong.

Sergeant Wright Interviews Divins

Divins was brought into the New Bethlehem Police Station for questioning and was read his Miranda Rights. He was asked if he wanted to talk to officers and was asked if he had been involved in any sexual assaults that he would like to discuss, and he allegedly stated that he had only ever had sex with three women. Divins was informed that sexual assault could include oral sex. Divins requested a lawyer. Questioning was stopped.

Divins Charged with 16 Counts

According to court records, Divins is facing the following charges for offenses against Victim #1:

– Corruption Of Minors – Defendant Age 18 or Above, Felony 3
– Corruption Of Minors, Misdemeanor 1
– Indec Asslt-W/O Cons Of Other, Misdemeanor 2
– Ind Asslt Person Less 16 Yrs Age, Misdemeanor 2

Court records indicate he is facing the following charges for offenses against Victim #2:

– Statutory Sexual Assault: 8-11 Years Older, Felony 2
– Statutory Sexual Assault: 8-11 Years Older, Felony 2
– Agg. Ind. Assault W/O Consent, Felony 2
– Agg. Ind. Assault – Comp. Less Than 16, Felony 2

Bail was set at $50,000.00 unsecured for each case.

A court date has not been set for the case.
